THE DISPUTE RESOLUTION PROCESS
parent is refusing to vacate the matrimonial home or if there is any threat of domestic violence or child abuse, the best solution may be to begin the proceedings in the Court in order to obtain the protection of the Court for the vulnerable party. Because litigation has so many purposes, it is an approach that will be discussed with you much more extensively during the few meetings that our of ces have with you in order that you can fully decide how you want to proceed.
As it will no doubt be clear to you by now, typically couples will use a combination of these approaches in order to resolve their differences. It is not uncommon for a family to attempt negotiations on some issues, resolve some issues, attend mediation for other issues and perhaps even litigate some issues on which they did not have much early success. All of these approaches will always be available to you during the course of dispute resolution and they will be used interchangeably as the circumstances suggest.
CONCLUSION:
As you can see from a review of these materials you are very much the person who is in control of this process. Our of ces are here to assist you in nding the solution that will work for your family. How you use those tools and what result you achieve will be largely determined by your participation in the process.
